new or old damage

we're sorry for the blury picture, but does this look like damage that happened a few minutes before the picture was taken, or does it look like old damage?

a woman reversed in to us while my hubby was geting into our car, she immediatly moved her car before he could get a picture of the cars together

she started shouting that he had hit her, he had me and the kids in the car, so he has us as witnesses

she is claiming that the end section of our bumper caused the damage shown

our car is the 4x4 you can just see the back of, the bumper is way too high to have caused that damage, and to us the damage looks old

  • Looks like it's already a bit rusty in places, so to me it definitely looks like an existing knock
  • I'd also say that's old damage, it's starting to go rusty so I say that's a few months old.
  • Cant really tell. As you say, blurry picture.

    The paint transfer looks silver though and the 3 sided piece of metal to the left of the wheel arch looks like fresh metal.

    Dont think you and the kids count as witnesses.
  • the large dent has mud in it for a start from splash's when s/he been travelling and rust has formed thats not fresh to me, plus there seems to be dirt all over the skirt which has faint silver scratches on. the person who has accused you is trying it on.

    The little semi-circle to the top right hand, just between the two white marks, that's rust. It's old damage..... But to be honest some people are too careless to notice these things for weeks/months after they happen, so she may well believe you did it.


    If she's pulling a fast one, she's rather stupid because even IF she won via insurance she'd face higher premiums for the next few years anyway.

    Anyone nearby on the street or in a business that saw it? That'd end it fairly soon, I'd imagine.
  • Dont think you and the kids count as witnesses.
    They do count as witness but clearly not independent witnesses.

    If it got to court the judge would listen to the statements and decide how much weight to give them because of the likelihood of bias. Insurers prior to court generally will give non-independent witness statements almost no weight if they'll even collect them.
