Urgent help, hospital parking ticket

    The hospital do not use a parking company, is it common for a hospital to issue these tickets themselves. Also I do not see a great deal on the net regarding Newlyns, the debt collection agency they refer it too for non payment

    Fair enough but it's still private land. It is not covered by statutory parking provisions and as such the Hospital have no statutory enforcement powers..THEY CAN NOT FINE YOU.

    Newlyns are well known for what is often termed "misleading communications" although lies would probably be more accurate for legal reasons we can't post that here.

    They will threaten all sorts of nonsense ,if..when,you get their letters feel free to come back for reassurance that what they write is utter bilge...the whole debt collector business runs on scaring people into paying ..they don't have any powers either.

    Except that they are a clear indicator that the land owner does not wish you to park there.

    That being the case any charge is not a contractual fee as the landowner never offered a contract to park there , quite the opposite....al of which means the charge is an UNENFORCEABLE PENALTY !!

    If they use double yellow lines [which as pointed out mean nothing on private land] then they would have to accept by using DYL's that a blue badge holder could park on them! As would be allowed on official DYL's as long as no other restriction was in force.
    They have muddied the water by using DYL's. As you have appealed they should allow it, if they don't ignore them!

    Yes they are clearly wanting to have their cake and eat ...and behaving like complete idiots in the process...it's either a double yellow line or it isn't (of course WE all know on private land it isn't).

    If they want it treated like a proper DYL then they should allow blue badges to park.
    If they don't allow blue badges having pretend DYLs is nothing short of entrapment IMO.

    If they put up a notice saying" No Parking including Blue Badges" they would effectively be putting up a sign that says "Actually this isn't a REAL DYL at all" ..and then everyone would park there !!!

    The Solution ???? Get rid of the DYL ..stop pretending to have statutory authority ( I note they call their ticket issuers Officers) and paint the road with the words "NO PARKING" !

    Oh and sack the parking manager .. he's clearly an idiot ..and probably ex-PPC !...
  • Hi, Im new to this forum so please bear with me if im going over old ground.

    My son had a appointment at our local NHS hospital in Whitehaven Cumbria, When we arrived the Hospital is undergoing construction work & hence has limited parking spaces availible.
    All the car parks were full & we circled the place for 20mins trying to find a space to no avail. Instead of missing my sons appointment at this busy hospital, I had to park my car on double 'red' lines, My car not being the only one (30-40 cars around the site & on the same stretch of road were all parked the same way) Some had blue badges, but most did not.
    When I returned to my car 40mins later my car 'ONLY' had a 'parking infringement notice' attached under my windscreen in a old clear money bag.
    It reads:

    PARKING INFRINGEMENT 08287

    your vehicle is infringing the parking policy of this hospital car park for the following reason:

    2. NOT PARKED IN A VALID SPACE

    REG No: (My reg was written here)
    VEH. TYPE: BMW
    LOCATION: MATTY (I presume this means maternity as it was near by)
    DATE: 25/01/12 TIME: 11.00am

    This infringement has been recorded but no further action will be taken if a cheque / postal order for £40.00 made payable to NORTH CUMBRIA ACUTE HOSPITAL NHS TRUST is attached to this notice & forwarded to the address below. Please note that further infringements may result in your vehicle being excluded from site.

    NORTH CUMBRIA ACUTE HOSPITALS NHS TRUST.
    Finance Dept., West Cumberland Hospital, Whitehaven, Cumbria, CA28 8JG
    NCA8112: 02/08 REV 4

    As you can see there is no mention of double red lines, a period or date by when this has to be paid.
    I took photos of where I was parked, & also took photos of 7-8 other vehicles on the same road (all which were 'NOT PARKED IN A VALID SPACE')
    I want to follow the advice from this thread ie, ignore everything they send, But my missus is a bit of a worrier ! :(

    Any help or advice would be most appreciated !
