Moving to the Support Group is not going to offer any protection if someone has already spent more than 365 days in the WRAG. Being in the SG does not offer an exemption, it just doesn't count towards the 365 days.

Many on ESA cannot without committing fraud claim JSA.
  • Can you please explain how this would effect someone on Incapacity Benefit who has not yet been migrated to ESA? xxx

If they migrate over, and are placed in the work-related-activity group, then they have one year of contributory ESA.
Then after one year, they move over onto income-related ESA, which is means-tested.

If they have a partner who works, they are unlikely to be paid at all.

Sorry if I have missed this posted elsewhere but there is so much to go through my head is spinning. But what decides whether you are to be placed in the Support Group, or the Work Group.

Thanks, I can see how it awards 'points' but I can't see how many points to decide which group.

You need at least 15 points to be placed in the WRAG, you can only score one set of points for each descriptor, so even if you think you score 6 and 9 points in one descriptor you can only score the higher (9). There are 17 descriptors; 10 for physical health problems and 7 for mental health issues (Annex A)

The Support Group is different, you need to meet one or more of the relevant criteria (Annex B)
