Lowell Portfolio
Noticed a search on my credit file from this DCA, and since my IVA has been settled, was wondering what they are looking for. I have no longer have any credit in place, but want to be forewarned if there is anything that they think they can chase. I know they buy debt from CC companies, I hope I am correct in thinking that any debt included in IVA is settled even though the debt has a new owner.

i would be carefull, they are very litigous and one of the few creditors that will go through with a bankruptcy petition, there is nothing they can officially do if the debt was settled through an IVA, but they can cause a lot of hassle if they try and persue a BO, that can be difficult to unwind later, so dont ignore them if they send you anythingHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

Lowell Portfolio 1 Ltd whose company strap line is "a better way forward" faces a claim from a person who will not be named until the end of an ongoing legal process who has contacted Financial Fraudster News with allegations of reckless and careless behaviour by Lowell Portfolio 1 Ltd resulting in a person being defamed.
Lowell Portfolio 1 Ltd who purchases second hand debts mainly from financial institutions have recklessly reported false and inaccurate information of a debt totalling over £11,000 formerly owed to HSBC.
We will refer to the alleged victim in this article as person B, Financial Fraudster News has been given access to person B’s credit file and documents issued by Lowell Portfolio 1 Ltd to person.
Person B a very successful commodities broker stated " Lowell Portfolio 1 Ltd disgust me, how can they carelessly link my name to a debt that is not even remotely similar to my name, the debt clearly belongs to someone with completely different initials."
Person B added "we have made contact with several victims of Lowell Portfolio 1 Ltd who have also been linked to debts that appear on their credit file and who are now being pursued and we will be calling several witnesses to appear and give statements on behalf of person B.

Reckless Behaviour
Lowell Group on its own website under the slogan better practices states - "Lowell Group maintains the highest standards of professionalism to both protect our clients' reputations and to establish ongoing and long term client relationships."
Person B only moved to that the address in late 2008 and has a totally different name and opened a bank account with HSBC in March 2011.
Financial Fraudster News has been shown person B credit file that clearly shows the debt purchased by Lowell Portfolio 1 Ltd had a default registered in 2007 a year before person B moved to that address.
Financial Fraudster News can reveal unbelievable reckless and careless behaviour by Lowell Portfolio 1 Ltd that Person B after a subject access request on 20th August 2011 received from Sue Hancock, assistant manager at HSBC UK data protection compliance based in Sheffield that person B had no records held by HSBC and therefore there was no debt owed contrary to the bungling and reckless behaviour of Lowell Portfolio 1 Ltd.
Person B actually at the time when Lowell Portfolio 1 Ltd was reporting falsely damaging information on person B credit file that person B actually opened successfully an new account with HSBC further undermining the position of Lowell Portfolio 1 Ltd.

In August 2011 a seemingly dramatic turn of events surrounding legal action brought against Lowell Portfolio 1 Ltd has occured.
Lowell Portfolio 1 Ltd who have now admitted to person B that person B does not owe Lowell Portfolio 1 Ltd any money at all, this decision now leaves Lowell Portfolio 1 Ltd in a very difficult decision, as their admission that the person B does not owe money has now had a legal and regulatory knock on affect that led person B to file a complaint at the Information Commissioners Office (ICO) who have stated that Lowell Portfolio 1 Ltd may have breached principle 4 that states all personal data shall be accruate and, where necessary, kept up to date.
Lowell Portfolio 1 Ltd now faces a six figure claim for damaging an innocent persons credit file by recklessly failing maintain correct personal data, we will keep readers informed of the outcome of the proceedings.
