Renting whilst Bankrupt

    letting agents also usually put in a termination clause as well so if you go BKY they can chuck you out, our's did.

    Mind you they said they credit checked us as well, at the time I had 5 defaults and my wife didn't exist on credit files (as she'd never had credit in her life) and they still gave us the house.

    Luckily we moved before the !!!! hit the fan but it always concerned me about the bankrupcy termination clause in the contract, we don't have one now as we're in Assured Tenancy.

    My house was sold when I went bankrupt, I had moved out before then but my ex husband was still living there. When the house eventually went he got a council house so that could be worth a try for you.

    Can anyone advise me as to whether letting agents do credit checks on you? My husband and I are in the process of going bankrupt and will loose our house. Will we have to private rent and wonder how bankruptcy will affect this?

    Have you tried applying for accommodation with a Housing Association? I work for one in North Wales and we don't ask for references or credit checks at all...in North Wales that is! Might be worth checking... ;)

    I have a very good landlord at the moment and lovely housemates in house I am renting at the moment.

    My main concern if I go bankrupt is that even though my lndlord is great, she will definatly throw me out because she is to the book very proffesional and if she has had even the slightest blip with housemates in the past, she has replaced them.

    I have never been behind with my rent and could prove this with backdated receipts........

    Would the OC possibly not tell the landlord because I have moved around a lot because of money issues. I have finally decided that going bankrupt is the only way foreward and I have finally found a house that I love ..... I suffer from very bad depression and I couldn't handle being chucked out!

    HELP!

    As I think I`ve already mentioned - our OR did not contact the LL at our request. No arrears either.

    If you have an agreement , check it to see if there is an eviction due to bankruptcy clause in it.

    If you are going BR check out the Bankruptcy and supporters club thread for advice and support. We are all a friendly non judgemental lot with loads of useful info between us.

    Hia, thanks for your advice...... My OR said that they needed to write to the Landlord advising them I was BR so I had to tell her.

    I called my LL and advised her of the situation and found that she was very understanding!!

    I thought I would have to find somewhere else to live because she doesnt usually stand for any messing around and I thought that there was such a stigma attatched to being BR that she would ask me to leave.

    Turns out that she was understanding and appriciated that I had been honest with her. I have always made sure that no matter what my rent was paid and she said that I have been a good tenent and that she would wouldnt expect me to move out. I was shocked by her very good reaction and wished I had been upfront stright away instead of fretting about what I was going to do and where I was going to live.

    I know not all landlords are the same but I have learned that honesty is the best policy and it is better to be upfront instead of fretting about who will find out. Telling her was a huge weight off my chest!
