hi guys

i know this has probley been coverd a million and one times but i cant find a answer to my question anywhere.

I will try and cut this as short as possible for you guys.

Basicly last wednesday i picked my new car up from a dealer. Its a 2nd hand 56 ford focus. I did test drive it and all seemed ok. I got home after the 2 and a half hour trip home there was afew niggles but nothing to major that i could pick up. Anyway i got home around 8;30pm so it was geting dark and had been working all day so was tired and figured i would take a closer look at it tomoz in the day. Got up on the thursday to go to work and wowww i noticed the engine managment light on and the fan came streight on also the temp was in the red so streight away i turned the engine off and checked under the hood. No water atall in the rad. So i filled the rad up it took 4lts of water to fill so it must been dry. Anyway took it to my local garage for them to check over they found the head gasket has failed along with engine misfire in cylinder 4 and afew other little faults.

Previosly to me picking the car up the dealer had just had the car mot so i asked if there was any advisory notes he said if there was they would fix them i must of asked this at 3 diffrent points befor picking the car up. the day i picked the car up i asked the samething the dealer said yes everything that needed doing has or would of been done.They also stated the advisory notes had been put in the bin so i couldnt see them Yet my garage has writen a report stating the rear springs should be deemed unsafe along with the back breaks these things where part of the mot advisory.

The garage picked the car up today. So basicly my question is can i demand a refund even if they offer to fix it?
I dont want them to fix it i dont trust them or the car anymore ive had it 1 day and all this has happend. Can i ask for a refund streight away?

Ive sent them a letter stating that i dont trust them to do the work and i want a full refund after trying to hide stuff and i dont want my kids in this car.

    If there are serious faults that they did not tell you about when you bought the car then you can 'reject' the car under the SOGA. You need to do this ASAP so I would give them a ring tomorrow and also follow up in writing.

    You can demand a full refund, but they dont need to refund you under any law.

    I've dealt with garages in the past, and comsumer direct told me there under no obligation to refund me, A verbal contract was made on there premises.

    If i got a refund it be good will gesture, which i did -100

    hi mo thanks for replying yeah all the mot advisorys we're hidden from us. Thats without the head gasket problems on top of the stuff they hid..


    My partner sent them a letter today stating all the faults and that we reject the car and we dont want them to fix it. They should get that tomoz.

    Normaly i wouldnt mind a dealer to fix a problem but i realy dont trust these guys. They've hidden stuff lied and also been very rude.

    Garages refunding customers just isn't in there nature todo it.

    All garage sales men are shrewd people.
