Sorry if this in the wrong place. My gym went into liquidation on Friday. New new gym is going to be under the same franchise group but under another franchise name.
I paid up front £400 for two years in September 2010 and the new owners as saying they are not honouring any paid upfront memberships. I think I am one of the lucky ones who paid on the Credit Card (hey haven't had a credit card machine for 6 months so I thought something was not right).
The new investors said they were going to honour the contracts but now they have took over they are not honouring the contracts. I take it they do not have to honour any previous contracts especially pre-paid memberships?
What is my best route do i claim under Section 75 on my credit card? I cannot find my contract does that matter?
If I do claim under section 75 how much can I claim? Do I claim for £200 as half the contract or can I claim for more as it will cost me £38 a month (cheapest in the area) to re-join a gym that will have squash courts as this gym looks like they are removing the squash courts.

What's the betting they're not honouring paid-up -front memberships, but are insisting that pay-monthly customers are tied into their contracts?0

You can claim for what the original gym has not supplied. I.e. the two year membership fee less an amout for the service already provided.0 -
£400 for a 2 year contract is £16.67 a month, so you can claim back £400 - (£16.67 x Z), where Z is the number of months you got to use it before it closed.
I would try and find someone with a monthly direct debit and see if they're being made to continue for the full contract term!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0
