Hi, my husband bought some Jeff Banks boxers from Matalan yesterday, 3 boxes, 2 boxers per box. At the checkout the girl did say that the boxers cannot be returned. But on unpacking them this morning I found that one box only contained one pair of boxers. I think, even though he was told that they were non-returnable, we should go back and either get our money back for that box, or be given a box with 2 pairs in, as it should be. My husband (not one to make a fuss) is of the opinion it's not worth it, as they won't believe we haven't taken one of the boxers out. I think we're well within our rights to go back, explain and either get a refund if they haven't got another box, or else be given a box with two pairs in. It's a bit of a no-brainer to me, but what do you think?

Take them back. Their 'these can't be returned' policy might be perfectly reasonable if you'd merely changed your mind. But in the case of faulty or missing goods (which these clearly are), they can't stipulate this as it will contravene your statutory rights under the Sale of Goods Act.

And they'll have a real problem arguing that you whipped one of the pairs out. The onus is on them to prove you did (which they can't) and not on you to prove you didn't. And, anyway, it's hardly in their best interests to accuse customers of being lying thieves.

Go back and get another pair of bobby dazzlers.

I bought some Calvin Klein boxers for my son for Christmas. When he opened the box there was this MASSIVE pair of y-fronts inside. He thought it was a joke. Matalan were OK when I took them back, and just gave me the correct ones.

If the worst they can say is no then it would only be a waste of your time. Personally, I think it alerts staff to an ongoing problem there - it's happened to me more than a few times and after the first I've checked the boxes haven't been opened. You shouldn't have to do that, but if you don't highlight it this company won't know it's being targetted so heavily by shoplifters!

How much is it going to cost you in petrol/bus fare to take them back.

I'm with the OH to be honest, i really couldnt be bothered. How much were they, knowing Matalan, they wouldnt be much.

McKneff, they're not far, so won't cost much to take back. They were £12 a box, so I think worth the trip.

Funny thing is smiley, I did look in one box to see they were the right style that he likes, it was obviously the box with the one pair in though, as I didn't realise, until opening them this morning that there should in fact be two pairs in there! .... I hasten to add, neither of us have that great eyesight without our readers on, so had missed the '2 pairs' bit on the sticker! haha

I had something very similar happen with Matalan, and thought there was no way I could ever prove that the items were genuinely missing. I gave it a go though, and they gave me the missing items without the slightest bit of a quibble.

Aw bless you, lol, take them back and the worst they could say is no but if you're going to, do it sooner rather than later to give it some clout. Best of luck!
