Money Claim Online want £120 for 1.6K claim, is it cheaper to go to local c.courts?

Hi Everybody

I am helping my brother and sister claim back 1000s, we are on with my sister just now who has been wrongly charged 1,648 pounds in two years. Usual scenario, they bounce a DD because the account is £1 short, charge her £35 and then bounce it a 2nd time and charge another £35 and a few other similar charges for cheques etc.

We are using MSE letters and have got to stage 4, the bank declined to pay. So we went to Money Cliam Online but was shocked that it wanted £120 for this claim. I thought it might be £120 for 4,999k (i.e. the highest in the small claims court).

My sister does not have £120 so does anybody have any experience of doing it ourselves via form filling and submitting a small claim through county courts??

    If you read to the bottom you'll see a section about what to do if you can't afford the court costs.

    It looks like your sister may qualify for an exemption of court fees. You can only issue the claim in your sisters local county court though. Use THIS LINK to find the local county court contact details. Give them a ring, they are very helpful and will say whether an exemption applies in this case, and what proof she will need to present to get this. To launch a case in the local county court, you need three copies of form N1 (get a spare just in case). You will need to fill in all three copies of the form (all the same), and three copies of anything you attach to the form (list of charges, particulars of claim etc).

    I always claim using these forms. When you are ready to fill them in, post back, and I'll give you the wording you need.

    got the N1 form, I assume my sister is the claiment and the bank are the defendants.

    Would you pm me or post me some good wording before I send it in to court.

    We also got a EX160 form which people can use to claim exemption from fees if you are receiving tax credit and earn under 15k so this too is very good news for them.

    Once we have done my sisters 1.6k we are starting on my Brothers they owe him 4.8k over 5 years.
