HELP - car written off advice needed

I basically need some help in claiming compensation for an accident that was not my fault. I feel that I don’t know where to start to be honest, I’m not sure what the procedure is.

I was hit from behind by a guy in a company van so the back of my car is now totalled, he must have been going quite fast as the impact felt hard (was on 30mph road and I was stationary waiting in traffic). I took it to a garage for some advice and was told my car will probably be written off when. Its pretty old but was reliable and probably would have lasted a few more years, it was an Astra diesel P reg with 89,000 miles on the clock.

I’m with direct line insurance, I told them the situation and am now waiting for them to send someone to pick up my car and evaluate the damage.

I feel pretty annoyed about the whole thing as the incident has cost me my car and a few days work to sort the mess out plus going to hospital for x rays as I got whiplash, all this through no fault of my own, the guy was probably on his mobile phone or something. I’m trying to find out as much as I can regarding what I’m entitled to but feel I need some advice.

Questions I have are

1. Is it likely in a case like this that the van of the company will admit liability straight away, how much would I be entitled to if so?
2. Will my insurance company deal with loss of earnings and other expenses or should I seek other help for this. Will my insurance fight for my rights or is it up to me to make sure im fairly compensated?
3. Is it worth asking a service like accident help line if I have a right to claim for more damages? in what order should i do this, should i wait for my insurance company to tell me how much i would be offered first?

Anyway, I’m pretty new to this insurance stuff and have no idea what I need to do to ensure I don’t get ripped off so any help would really be appreciated.

  • I'm with direct line have have had an accident 18 months ago where a guy reversed into me
    I have had terrible whiplash and it caused me to slip a disc in my neck .they ( his ins comp)are paying for me to see an oestopath which has helped so much wish I visited sooner and not after 12 months post accident .

    I had the legal bit on my insurance.
    you pay and extra bit check your certificate.
    This has covered me they have done all the chasing direct line instruct them to work on behalf of you.
    keep all reciepts dates of visits to drs and copy of perscriptions which I did not do .
    it takes a long time I'm still waiting for reimbursement even though he eventually admited liability . they chased him through his no plate phone no and first name he gave but would not answer phone or give address!!!

    the legal part solicitor deal with loss of earnings etc .
    give direct line a ring they were pretty good with me but it does take a long time .
