Advice needed asap Brother in law soon to be ex wife taken out cards etc in his name

My brother in law has just split up with his wife, on her briefly leaving the rented house (no real assetts except the cars) he has found some documents relating to credit cards in his name he never knew he had with lots of debt, she has lied to the tax credits saying her children are disabled when they are clearly not (he has phoned them to say stop paying and why), his business account (a haulage business with rented offices and no vehicles of their own) which has only his name on the books has customers paying money in and she has transferred it straight into her new boyfriends account within a day without his knowledge.

He is very niaeve and trusted her completely so this has been going on for a few years. her house they had when they got married is being repossessed. He is in a very low state and we do not know where to start. How do we find out what debt he has - do the credit companies when they run credit histories log all debt, who do we go to to get this sorted out as clearly if anyone compared the signatures on cheques and agreements they could clearly see they were not his and they have been fraudulently completed.

She used to always get up first to collect the post hence why he never knew and has only just found out about her gambling problem.

A big mess I know but if anyone can offer any adive we would greatly appreciate it as we just don't know what to do. Thanks for reading and heres hoping you can help me set him on the path to beginning his new life.

    He needs to get his experien/equifax/credit expert reports - that will show him who he's supposed to owe money to. Then once he knows he needs to stop any further spending in the account ASAP (cancel the cards/suspend the accounts etc). Doubt the police will be much help but if all this is without his knowledge then it is fraud so I suppose to strengthen any case against her in the future he at least needs to report the crime and get a crime number.

    PS it's your Brother in law? So the evil wife is your sister??

    I am far from a expert.....but thought I would give you my thoughts. I guess that he could contact the credit card companies and they would beable to get him a statement sent out of the account to his new address. If it was me I would contact the police and ask for their advice if he didn't know about the debt. Who's name was the cards in? If just his then sounds to me like the ex could be in alot of trouble.
    It would probably be a good idea for him to open a new bank account too asap for his customers to pay into.

  • cards are in his name although he did not know they existed, she always got to the post first...... will have to run a report as suggested to try and find out what she has actually taken out!!! he has now been removed from the house and is not allowed back because she needs it for herself and her kids (nearly all grown up)plus the new boyfriend. So now chance of getting the post now.

    he needs to fill in a form to do this
    however he should go to the delivery office and explain the situation
    they should be able ot put a hold on his mail pending the collect application
    he wont be able to get the mail but it will at least be held

    its more common than you think
    relationship breakdowns etc
    we used to have one old dear who didnt want her alcoholic husband getting to her mail(think she kept money tucked away)
    at least once a month he would be up complaining the postie was stealing his wifes mail
  • Didn't realise it was so common, I must have lived a sheltered life, I feel sorry for people that have to do that as a normal occurance.
