Renting from family and housing benefit

Single people without dependents and who get a low income who work 30 hours per week can qualify for working tax credits which aren't means tested in the same way as other benefits - you'd have to delcare interest on your savings above £300 I believe
see the info on the HMRC website and you can use the calculator on the Turn2us online benefit calculator to see if you qualify0 -
The staff at the benefit agency learn rules and regulations which they quote parrot fashion, without
any idea of the laws they are made under. However helpful and under stress these people may be,because they are government officers people believe them. I must have read more nonsense in the last few days on this board by way of advise than I have ever read in any newspapers.
1)I read on an other forum that they ask for people's bank statements, under no circumstances hand over any of your personal information,we all live in a free country, under the rule of law, you have the right to be believed if they have evidence to suggest otherwise then ask them to produce it,otherwise get stuff&d Thats the law and long may it remain so.
2)The age of maturity in this country is 18 not 20 or 25,that means you can freely enter into contractual relations which are binding on all including government departments.
.
3)There is no law that says you must fill out an application form. In law, all you have to do,to qualify for housing benefit, is offer a letter containing your name, your address the date, N.I number proof of your income and your rental amount the name and address of your landlord. They must accept that. Housing Benefit is a legal right not a discretionary one, it is therefore governed by the law of the land, and not rules and regulations, they are there to assist in administration only.
4)Anyone having their rent restricted p.m me, and under no circumstances sign a pre- tenancy determination agreement I have already asked for this to be withdrawn so we shall see what happens.
I have prepared a letter for the secretary of state reminding him of the master servant relationship, whereby we the people are the masters and he is our servant and he is in breach of the terms of his employment, by misleading people in a manner which constitutes gross misconduct and therefore warrants instance dismissal.
P.S rumors have it, that a large delivery of toilet rolls where seen being delivered at the department for work and pensions. I can't, of course, confirm this as a fact. Not yet anyway.
they ask for evidence of savings... if they want bank statements they ask for them...
its your choice to supply them... if you dont supply them, they cwill not pay you for failing to supply evidence...
my council writes to me every year for "updated statements" within 30 days... i didnt recieve this letter, so didnt take any in, no payment was made so i called up they explained why,,, i supplied the bank statements and got my payment about 5 weeks later...0 -
You only need an official tenancy agreement drawn up and signed then you can give it to the council when applying for housing benefit...0

I wonder if anyone can help me (I know this prob been said but to many pages to read).
I'm buying a new home and will be renting out my current home. My sis in law qualifies for housing benefit in which she's been told she can get £432 per month towards the rent. I will be charging her £450 which is very good rate for 3 bedroom house in this area and she will make up the remaining £18 to cover the £450 rent.
Will the fact she's my sister in law prevent her from renting from me? It's all above board and the rent is very cheap so it's not like we are trying it on or trying to rip anyone off.
Can anyone see this being a problem?0 -

I've read that, they don't give much away really on that.
I can't work out what contrived tenancy means.
At the end of the day, even tho it's my sister in law I want to do it as I'd do with any other tenant. I want my rent every month and paid on time with a tenancy agreement.
We not looking to play the system or anything dodgy. I want to rent my house out, my sister in law looking to rent a property. It's just common sense really.0 -

"arrangement has been set up to take advantage of the housing benefit system – this is called a ‘contrived tenancy’."
Seems clear enough?
Will she be paying rent "on a commercial basis"?I want my rent every month and paid on time with a tenancy agreement.
Seems to be what the council will require?
In the end, only the council can give your SIL a definitive answer after
"a detailed look at.. agreement with.. landlord".0 -

I don't understand what the commercial basis is. This is first time I've rented out a property so I'm little green on the subject.0 -

If you mean am I looking to make financial gain on renting out my property, the answer would be yes. That's why I'm doing it for extra income and it's also me pension when I hit retirement age.
What you getting at ?0 -
Is £450 the going rate for that type of house, or at you charging £450 because that's all she can afford over what she is receiving? It might be seen as contrieve if you are lowering the price for her when you wouldn't for a stranger.0
