Won back charges but blackmarked

  • Listen..what i dont understand is i have been defaulted for a charge that they for whatever reason refunded me,not been defaulted by my debitors as they were paid but by the bank.So if they gave back my charges how can they black mark me for them?
    Either i am being really dumb or im not explaining myself to well

    From what you have said, you had your charges refunded. This does not alter the fact you missed/dd failed (or whatever it was) in the first place, you just didnt get charged for it. But it doesnt alter the fact it was missed in the first place.

    Think of the default and the settlement as two different transactions. At the point they loaded the default, you were in debt. The bank charge refund came in later and refunded that debt. However, the money could have come from personal savings, or inheritance of a family member. The source is largely irrelevant. The money settled the debt.

    When the bank refunded the charges they usually did it as a goodwill gesture. So, in effect, it was a windfall payment to you. They were not saying their charges were wrong or that they were at fault. So, the fault for the debt still lies with you.
    So if they gave back my charges how can they black mark me for them?

    Because your actions still created the debt in the first place. Giving back some charges was an act of goodwill. Not an indication they did wrong.

    a basic santander account can not appear on your credit file as it is not classed as i current account i know this as i had a similar problem with them , mine was found in my favour and there error , they had issued some d/d return fees even though they had been cancelled in writting to them , they then refunded them but issued default on the same day . i then got them refunded and the default removed .

    it took nearly 10 months to do this , but during this process i was told that my basic account should not have appeared on my credit file as they are unreported as they dont have the need to be as they dont allow over drafts etc .

    one way they get around it is to changed your account over on there systems to say a different type of account , i found this out and pulled them up for it ,

    try your luck with this route but if you did have returned d/d and knew about it really you should just take it on the chin and learn from your mistakes .

    I will just add that despite us pointing out the reasons why it exists on your file, it doesnt mean Santander wont remove it if you argue the case with them. Banks are quite scattergun in the way they handle complaints. Sometimes they cave in when they have no reason to and other times they will fight tooth and nail when they are in the wrong. If you dont ask you dont get when it comes to banks.

  • Had a call from santander today saying they received a email back saying they have no record of this or of my refund and to call the complaints line.
    Confused now.
  • Spent nearly 2 hours on the phone today,explained the situation 6 times to different people..of which two rudely hung up up after asking me to hold.Eventually was told i was defaulted for letting my overdraught(i have never had one or asked for one) run poorly(charges being the overdraught).So back to my point,how can i be black marked for refusing to pay charges which they even wiped.I only never payed them after seeing martin lewis telling us to contest them in 07.Never mentioned i may get defaulted though did he!.Also they said my account was £53 in credit when they closed it...where's my £53 then??.Now i have had to log the whole story as a complaint and can expect to hear from them in 5 working days.

    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
