Won back charges but blackmarked

Back in 2007 i contested several debit charges with abbey national of which i won and the amount was wiped,they also closed my account without telling me.
I now bank with lloyds and have been refused for a small loan to which i was advised to get a experian creit report which i did. My history is perfect apart from a black mark from santander/abbey in 07,it seems they have black marked me for winning my charges back.Surely that is wrong,my bank says i may be entitled to compensation for hardship?.
i went to santander today to sort this out and after we established that i may have been wrongly stitched up by them..the young lad told me they dont have a contact number for issues like this and it's all done through e:mail.
Great,so now i have to sit here in dire straits waiting for them to contact me which could be weeks or months for all i know.I am in desperate need of a loan and santander have maced me.
Please somebody must have experiance of this or advice for me..How can they get away with this

There is no such mark possible that can be put on your file for that reason.
The mostly likely thing that has happened is that a bad debt position was on your credit file prior to the refund of charges and they never marked it repaid. A refund of charges does not automatically clear your credit history.
Can you clarify what it shows on your credit file?
Also, can you clarify if the information is correct in relation to your position at the time (prior to refund of bank charges)?
Finally, can you confirm your bank charges complaint was upheld or whether it was a goodwill gesture that they refunded?I am an Independent Financial Adviser (IFA). They most likely refunded the charges because the charges were unfair.
The charges would have been due to unsatifactory conduct of your account and that goes on the credit records.
Why did you incur these charges in the first place?0 -
They were unfair charges for a returned dd,so it's unfair that they ruin my credit history.They cant do that can they?0

It was only a basic debit account and had no overdraught or cheque book.the only debt i had with them was for the dd charges that i won back.Im confused how i have bad credit by them and tbh am not to clever with all this stuff.My bank manager saw my report and says everything else is all in order,no payments missed at all and everything else is satisfactory.

This indicates you didnt pay in time but it was settled a month later.It was only a basic debit account and had no overdraught or cheque book.the only debt i had with them was for the dd charges that i won back
You got overdraft charges because you went overdrawn. You got lucky with a refund as it was before the court case. Post court case, you would probably have got back nothing or a smaller amount. The important thing is whether they refunded as a goodwill gesture (so your complaint was not upheld) or whether they upheld your complaint. The former means they dont have to clear your record. I may be being a bit dumb here dunstonh but im sure it was returned direct debits ie..they did'nt give me an overdraught for them but charged me a fee.I think i need to hear exactly what they have to say about it all and cross my fingers hard,as later life is a !!!!! with no credit!

so it was your fault. the charges refunded doesnt mean there was not wrong doing on your part, they just didnt charge you for it.
credit reports are there for a reason, if theres a default its no ones elses fault apart from yours.0 -
Without actually seeing the documentation we cannot be sure but I would guess that the bank made a refund of the charges without admitting fault.
The test case then found the charges WERE fair. That in turn means it was you, not the bank at fault. In such circumstances the default was your fault and the bank is entitled to register it.0
