Quick question about refunds

hiya 
i bought something of ebay that came as described barring a card which wasnt mentioned in the listing so i presumed it came with it.
to replace one of the figures that were missing from the tin would cost £6 (this i knew about) but to replace the card would cost more and i could buy the item brand new for less.
i have contacted the seller about returning the item and he said thats fine but he would deduct postage fees
can he do that?

Most people would say you should have asked - I'm inclined to agree with you, though I think the seller should have been more explicit in saying there was something of the original package missing. Would it have been obvious from the picture that the card was missing? Do you think you were misled into thinking that the item was inclusive of the card? It seems odd they would mention that a figure was missing but not the card; perhaps they thought - as you do - that the figure is easily replaced, but the missing card would reduce the item in value such that it was not economical to sell.
I think you may have a case for an SNAD (which will get you your original payment back; doing the dispute through eBay might get your return costs reimbursed or a no fault refund granted; the seller may, however, contest it, depending on the strength of the listing), but it may be better to ask next time if you have issues with what is or isn't included, or buy something you know is brand new. Those kind of confusing listings are a PITA - I bought a book a couple of years ago where I specifically wanted one "full" edition but was sent the "condensed" version - because it wasn't mentioned on the listing which version it was. At least if it had said "condensed version" I wouldn't have bought it, and it's not like the seller could have made a mistake.

If they won't do it voluntarily then you may have to force a refund with a dispute. A dispute for SNAD will require you to send it back tracked at your cost. You will get your entire original payment back.0
