    Ordinarily, the underwriter has no responsibility for the sale, they simply follow instructions.

    For a complaint to be successful, you would need to show:

    1. The firm selling the policy did NOT subscribe to the General Insurance Council's code of practice at the time
    2. The insurer did subscribe to the Code.
    By doing this, you establish a breach of the Code by the insurer because it could only accept business from an intermediary that also subscribed.

    If you can then persuade FOS that, but for the breach by the insurer you would not have purchased the policy, you ought to get your complaint upheld (but not otherwise).

    sorry for such a late response, i left it as i thought i had no chance.

    Cut a long story short, i found a few things and then i decided to open up to the FSCS a few weeks ago about the matters.

    They are now investigating the issues and believe I can claim. I dont know how this all works but they have stated they will contcat me.
