Play Trade - Non delivery

What are me rights regarding the length of time I keep getting fobbed off. I purchased an item from Play trade because it was cheaper than Play.com and said delivery was 2-3 days, that was on 27/08/11. I contacted seller on 02/09/11 and received an email saying there was a backlog and item was sent out that day. Sent another email on 09/09/11 to seller stating it still hadn't arrived they replied saying to check with local post office and to give it a few more days was not willing to wait any longer and I contacted play.com customer services who emailed me a claim form which I printed off and sent away. Claim form it would be resolved in 7 days . Called CS again today to be told it was the wrong form and its the seller I need to contact for a refund:mad::mad::mad:
This is now 4 weeks after I placed the order and 4 weeks after they took the money from my credit card. I have contacted seller AGAIN what are my right?
I feel as if everyone is passing the buck

Sorry for rant any advice greatly appreciated:)
