Excel lose in court. Again.

Excel lose on inadequate signage

You'll have to grit your teeth at some of the poor journalism, but still a useful result because we all know how tiny the text is on Excel and VCS's horrendously designed signage.

    Love this one!

"She said: “The lettering about failure to comply is about four times larger than the lettering saying it is a pay and display car park, which tells me the real interest is in failure to comply"

    Well spotted your Honour!!

Glad they lost but ...how confusing....if the sign very clearly tells you the "penalty" for not buying a ticket ..then doesn't that tell anyone with a brain that you need to buy a ticket in this car park ?

The logic if the reporting is accurate is lost on me .

Would love to see the transcript ...

"Parvez Mirza, representing Excel, told the court that by parking in the car park, Mr Cutts was agreeing to the terms and conditions of the facility and the penalty that would arise from failure to comply."

Did she REALLY say this ..I mean did she really use the term PENALTY ?????
...talk about shooting yourself in the foot ...that's more like shooting yourself in the head !!! :rotfl:

Are they the same person or related as both are obviously first degree muppets :rotfl::rotfl:

I wish the press would stop referring to these illegal civil penalties as FINES:

"Martin Cutts was issued with a £60 fine – which went up to £100 when he did not pay within seven days – after failing to buy a ticket. He refused to pay the fine and argued that the signs at the Peel Centre car park were too small."

it helps spread and reinforce the misconception that these PPC's actually have a legal right to enforce their toilet paper invoices, which actually they haven't

I think this piece finally enables us to identify exactly who or what "represents" and has "represented" Excel and VCS in the recent past.

Remember the abortive NPO applications in Melton Mowbray?

A little research and lo and behold a Parvez Mirza and a Naveed M Akbar (as opposed to Navide Akbar) are partners in Legatec Solutions Ltd which is essentially a outsource law firm. Naveed is a barrister and Parvez a solicitor.

This is too much of a coincidence and I suspect that neither Naveed nor Parvez are actually the "Litigation Manager" or ever have been as such but that Legatec Solutions Ltd is more a far more likely candidate.

Legatec are based in Dewsbury, W. Yorks but are somewhat bizarrely listed as "Dormant" at Co. House.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

HO87 I remember someone putting Naveed M Akbar's name in the hat on the Excel NPO fiasco. I for one didn't think it would be the same man, It looks like it is them after all!

    Business must be slow!

Think the spelling was wrong and this is him:

Naveed Akbar ... let a whole new round of anagramming commence.

My favourite - Bad Knave Era.

    Now apparently sadly ended.

    Knew I had seen it!
