Capital One query!

Was wondering if anybody can help me with this one!!

Last week I posted a SAR letter to Capital One. The letter was dated 7th September 2011. I called them a couple of days letter to see if they had received my letter to which I was told that they werent allowed to tell me!!

I was put on hold for ages and when the customer services lady finally came back to me the response I was given was that they are allowed 40 days within which to respond to the SAR - once they have banked my £10.00 cheque. I was already aware of the 40 day wait but all I really wanted was to know whether the letter had been received in the first instance - this was when I was told that they werent allowed to tell me!!

Surely this is just courtesy to let me know that it is received. I am more than happy to wait my statuatory 40 days for a reply. But I am not very happy not to know if they know if they have my letter or not!! Also as of today 15th September - cheque not cashed so the 40 day clock has apparently not even began to tick!!


Any ideas if the above is correct or not. At this rate I could be waiting forever before I even get a response to the SAR letter.

  • It's 40 days from date of letter, not from when they cash the cheque. Capital One seem to have a different view on laws and regulatory rules to the rest of the world.

    Tell them that you will report them to the Information Commissioners Office if they don’t start abiding by the law. If that gets you no where then do actually report them, the number is 01625 545745.

    Cheque for SAR letter cashed today 16/09. Called Capital One to see if they were calling today day 1 of 40. They are the biggest load of ********* (I cant even think of a decent word so its just all stars im afraid and you can fill in your own). They refuse to tell me when they received the letter - although they can confirm that its somewhere between 07/09 when I wrote it and today when they cashed the cheque.

    And the reason why they wont tell me when they received it is because they say that they cannot identify who I am over the phone. Apparently I have had two accounts with them. Two are registered on my credit file. Although I know full well I have only ever had one account. They have zero transactions on the other one. For some reason they say I can pass their 'security' on the duff account but I cant clear it on the actual account in question. So who knows?!!

    Anyway I think I will call today day 1 for the sake of interest. The clock is ticking...!!
  • 40 days can normally be started 2 days after you sent letter. I got mine after 30 days even though they denied receiving it. Anyhow a few days late isn't too much to worry about as long as they do it.
