Credit Card help

I'm in such a pickle.

I was cold-called by a PPI claims company 3 days ago and I fell for it.
Since googling the company brought me to here, I've learnt a lot and now I'm quickly trying to get a refund and a termination to the agreement.

One of the things I wanted to ask was about the credit card that I used to pay over the phone. It's in my husbands name and the company knew this, yet they still took payment. I'm wondering whether they've breached anything by not talking to the cardholder himself to authorise this payment? It's not the focus of my letter and email to them, but I thought it may give my cause extra clout and may rush my refund through quicker. Lots and lots of posters on this forum have never seen their deposit back. It was £350 :mad:

I know I've been stupid, very much so. Feel free to tell me so, I deserve it. :(

    Were you an additional cardholder on the card account? If so - the payment was legitimate.

    If not, and you gave it without your husband's consent - that is fraud.

    My husband allows me to use the card (I booked flights over the internet with it, and he was happy for me to do so) but no, I'm not a named additional cardholder. I know I'm in the wrong, but is this company in the wrong too for taking the payment?

    hi i wrote to hsbc to claim ppi on my credit card which i have had for 9 years they wrote back to ne saying they received my complaint and that it wood take 13 weeks instead of 8 tant was about 13 weeks ago i read that lots of letters have been sent out telling people what they will get back do they also write to you to say your not intitled to any thing back its so anoying

    Firstly, check whether you have any kind of cooling-off period. If so, write to the PPI company cancelling, and let the credit card provider know what is going on. Should the PPI people fail to cancel and return your money, the credit card provider is also liable.
  • Voyager, thanks for your advice. Can I ask (sorry to sound a bit dim), how will the CC provider be liable? How can I pursue this should the PPI company pull a fast one?

    Because you are covered by the 1974 consumer credit act. That basically says that if the company you are dealing with doesn't do what it should, or goes bust, then the credit card company is equally liable to refund your money.

    The important thing, as Voyager says, is whether you have a cooling off period, which I would expect you would have as it was a cold call. To cancel it you almost certainly have to write to them, it should be in their written Ts&Cs.

    I don't suggest you pursue the 'no authority to use your husband's credit card' line. As has been said, he would have to claim you used it fraudulently. And even if he did get his money back via that route, the company could still pursue you for the debt. Though it's perhaps unlikely they would, I wouldn't embark down this road.

  • Sorry - have been poorly for quite some time, so I wanted to return to say Thank you.
    Update: I put everything in writing, and sent a cancellation request via recorded delivery to this company.
    After no end of chasing, the last call I made I was told that a full-refund was stated on my file, to be issued via cheque on the 24th.
    I'm still holding my breathe and won't be fully at peace until I see the cheque in my hand. I will let you all know what happens.

  • How did you fall for that? It's a scam as old as time. "We can solve all your problems just give us £XYZ up front and i'll sort it out." probably best to let them keep the money, someone door to door salesman will just get it back off you with the promise of some magic beans or something.

    I'm receiving some pretty hefty treatment at the moment, which does leave me fuzzy to say the least. It was a bad call, poor judgement and something which I bitterly regret and have been anxious over ever since.

    Still, your contribution has cheered me up no end. :(
