Definite Tupe/Possible redundancy

Hoping for the best but fearing the worst - possibly being Tupe'd over but obviously the possibility of redundancy

Currently my contract states my notice period is 3 months so would possible redundancy package comprise:

Statutory redundancy pay (non taxable)
3 months pay in lieu of notice (taxable)
Any accrued holiday pay (taxable)

Also I would imagine that if the company I was being Tupe'd to decided to make me redundant they couldn't make me work my notice (as I wouldn't be able to work in a redundant job that didn't exist )

Any advice appreciated

    I was in a similar position to you in April, tupe'd across to the new company informed 3 days later no role etc and then made redundant.

    I can only go by my experience but the company need to consult with you on the risk of redundancy and this will generally include a couple of meetings to discuss process and any options available.They may well put you on gardening leave during this time as you would not have a job, just attend meetings as required. If you are in a union make sure they are aware and get a rep to attend with you. Whilst your existing role may not transfer across the new company should make you aware of any other vacancies which you might want to consider if you have any transferrable skills.

    On the redundancy package generally they want to finalise matters quickly so would probably pay you off in lieu of 3 mths notice rather than have you sit at home. If you work in the public sector they may pay more than the statutory redundancy rate. Outstanding holiday will also be paid. If you are part of a share, bonus, or performance scheme you need to check if you would be eligible for any payment. Not sure how that would work.

    I also kept my company car when I was on gardening leave. Check this out if it applies to you.
