Failure to relicence vehicle Grrrrrrrrrrr

I part ex'd my car in October, took the tax disc off and received refund. Filled in the slip on the log book and sent that to the DVLA.
Today i've received a penaly notice for failure to re-licence the vehicle.
I can pay the reduced penalty of £40 by 5/2/07 or £80 :mad: by the 5/03/06 plus back duty of £18.34.
It states that even if i no longer have the vehicle i must still pay the penalty and fill in the back of the form and write to discuss any exceptional circumstances.
Any advice please

Did you get a letter from the DVLA saying that they had received the slip and acknowledging you are no longer the owner?0

To a local garage and the slip was definitely sent off0 -
I would pay the reduced fine for now and accompany it with a letter of appeal telling them when and to whom you disposed of the vehicle. Presumably your new car was registered in your name not long after you are saying you sent off the slip...they can check this easily...its a bit of evidence that supports your claim. Your local garage should have a record of whom your old vehicle was sold to. If they refuse to help it may be because they sold it 'off the books', others in this forum could advise you on how to pursue that possible issue.
Personally, I would think you have a good chance of reclaiming your money. I was reimbursed £190 by the DVLA a couple of months ago after an appeal that took about 6 weeks to complete (it was not for a similar issue to yours but at least you know that its not impossible to get money back off them). In any letter of appeal I always ask for a full written explanation to be given in the event of the appeal being unsucessful and I always ask them to clearly explain how I can take a complaint further...politely. It usually does the trick.

Same thing happened to someone I know, and a letter he got from the DVLA confirmed that a lot of these forms go missing on arrival at the DVLA.0
