Which I said in my first post.
I'm trying to point out that signing a form to say you're someone's carer is unlikely to be a carer's allowance claim form. Unless someone else was committing fraud and applying in your name with their own bank details.

The Bossy little sister (accountant) she likes to call herself ask my wife to sign forms stating she was the carer for her mum, who was 59 with TC.
According to the wife she was told it was just to say she had someone to look after her, my wife visited every day sometimes twice.
The MIL received full disability benefits and a mobility car, which the son of the bossy sister basically drove around in cost free as MIL became to ill to drive.
Now I have a feeling reading about benefits that this bossy little madam got my wife to sign the forms and had the money attendance sent elsewhere whilst my wife did the work.
Now, we dont want benefit money, thats not our style, but what we do want is to find out if Mrs Bossy pocketed the payment but before this we need to work out if such a payment entitlement would exist.
MIL was a wealthy woman but not in cash and she had large amounts of gold, very large amounts probally in the region of £30 k worth in coins and jewellery , Mrs bossy refused My wife to see the will, just giving her cheque for her pittance share of the rest of the estate, minus funeral expenses of 9k, however I knew MIL had a pre-payed funeral plan as I helped her get it.
Mrs bossy insisted this will stated that all jewellery went to Mrs bossy.
now not being a complete idiot I sneakily sent for a copy of this will we never saw which simply stated everything to be split equally and nothing else.
So I know she pocketed the Gold which at today's prices would be around £100K.
What I would like to do is explore the benefit issue and see if there was an attendance allowance which my wife signed for but paid elsewhere then as it is eating at me, I will drop Mrs Bossy big mouth right in the brown stuff.Hi, we’ve had to remove your signature. Can your wife remember if the forms said they were to do with benefits or anything else? Surely she read something on them and didn't just sign in a box with everything folded out of the way? Was your MIL in hospital at the time? I suppose it's possible that social services or someone could have wanted written confirmation that MIL wasn't going home to be left struggling on her own.

It can't be Attendance Allowance because of her age, so it would be DLA. A mobility car isn't just given, you have to exchange your DLA mobility allowance. which the son of the bossy sister basically drove around in cost free as MIL became to ill to drive. That's against the rules but I can't see you getting anywhere with a complaint about it.

I'm really sorry to hear about the problem with the will, my mum died in April and the attitude of her family really stank.
I think to sort out the benefit thing we need to work out what she/your wife would have been eligible for, then whether anyone got it for her. It would be a big help if your wife could remember anything about the form she signed. Would she recognise it if she had a look online at some forms?
What was your MIL living off? Did she have savings? As you don't know anything about benefits, even your assertion that she 'got full disability benefits' can't really be taken at face value (I don't mean to be rude there, I'm just pointing out that what you call 'disability benefits' may well have a different official name). So we need to know if she'd be eligible for replacement income benefits - ESA/Incapacity Benefit, income support. I'm guessing if she had so much gold and jewellery that she probably had savings that meant she was ineligible for means tested benefits.
So, for the income replacement benefit - we need to know if she had any other income, if she had savings above 6k or 16k, and how long ago this was - when the claim would have first gone in.
'Disability benefits' usually means DLA. We know she got Higher rate mobility, because she exchanged it for a motability car. It's easy to assume that with TC, she would have got higher rate care, but it's not that straightforward, especially since she lived for two years (for it to be automatic death has to be reasonably expected within six months, or for a doctor or nurse to say so). If she deteriorated slowly then she could have been on a low rate and not reapplied when things got better. Do you have any access to paperwork to find this out? Carer's Allowance is dependent on DLA rates.
How long ago did she die? I'm not sure you have any right to call the DWP and ask what benefits she was on, but if it's fairly recent you could call to inform of the death - for probate you'll need to know if she was owed any back pay or if she owed any overpayments, so you could reasonably ask for that info - I'm sure Mrs. Bossy would welcome the help with dealing with all the crap, making her load easier etc.
I'm assuming here that you can't just ask Mrs. Bossy for the paperwork and get it? Cos that'd make putting this jigsaw together a whole lot easier...Unless I say otherwise 'you' means the general you not you specifically.0 -
I think you need to forget about the benefit issue as it's pretty clear you and your wife haven't got a clue. Surely your wife must have read what she was signing?
I think you need to concentrate on the above part of your post, the will if you and your wife have been diddled and as you say it's there in black and white who should get what.
You dislike your SIL that much is obvious from your posts but the benefit issue I think you are flogging a dead horse.I made a mistake once, believeing people on the internet were my virtual friends. It won't be a mistake that I make again!0
