Nightmare neighbour & landlord. Help!

    Don't be harsh, the poor lad has suffered cycle logical damage, so he tells us in his wish list.

  • Hi - you appear to have 3 main options:
    1) attempt to move back into the house and get everything sorted thorugh the proper channels - ie environmental health, housing support at the council, shelter guide for enforcing repairs etc ,as well as the police and getting a restraining order against violent person.
    2) moving out and onwards and trying to get out of the contract as best as possible or
    3) do nothing.

    It appears that you wish to do option 2. It might be worth giving Shelter a call on this one.

Really not important in the grand scheme of things and frankly a waste of time/resources in my opinion and may detract you from actually sorting out the main issues. If it was that important to you you should have had something in the contract about it/ double checked it worked - a pain yes but worth sueing them over? I doubt it.

    This scenario would help me finance the end of my dad's mortgage and convert the place into 2 properties which we could both live in peacefully and out of harm's way.

    Frankly I think you need to focus on ending the contract and getting your deposit back and possibly rent back and look to move on.

  • As time has moved forward so has my way of thinking about the incident. I removed all possessions from the property, cleaned it properly and photographed all the damage/hazards. I am requesting the landlord take their keys back and that they repay me just my agency fees, advance rent and the deposit for now. I'm not a greedy person really, and will gladly just take this back so I can look into investing it in a safer place to live.

    Other action I have taken:
    *Contacted Victim Support for my area. Also contacted Shelter. Contacted C.A.B and made an appointment.
    *Decided not to take further action on the tenant until the court hearing on 26/09/2011.
    *Been in touch with Deposit Protection Scheme, and requested the deposit back through the correct procedure.

    Actions yet to be taken
    *Filing a case for small claims in order to retrieve the advance of rent and agency fees. This depends on the landlord's willingness to return this sum of money without it going to the courts.
    *Further legal action. This depends on the advice from C.A.B, a couple of legal buddies.

    To those have replied sensibly, thank you very much for your realistic input. It's helped me come back down to Earth (a little!). For those that haven't, you should be ashamed of yourselves as there is clearly a reason why some are thanked thousands of times, while others are thanked very few. I at no point demonstrated an inability to spell or be open to suggestions so the "cycle logical damage" comment was both pathetic and inappropriate.

    Thanks again everyone. I am going with option 2, dancer, as I am in reality an honest person and simply want to fulfill a life goal which is own or rent my own place. Anything else is a bonus, and I already have a few honest ways in mind to better my health and finances. Consider this closed!

    Good luck in getting this sorted out but be aware as already advised in this thread that your chances of legally forcing the LL to comply with your demands regarding return of the rent, fees & deposit are slim. You have signed a contract and are bound to it for the 6 months.
