dla question-would this be allowed?

Hi there,

Both myself and my partner receive dla for our respective disabilities, myself the lower rate for care and mobility and my partner middle care and lower mobility.

Our child is ongoing tests at the moment for autism and the health professionals are reasonably certain that this will be confirmed.
I do know that some children can be awarded dla for their care needs, and our child does have extra needs compared to other kids his age. but to be honest I would be reluctant to claim for our child as I feel the DWP might think "oh that family is claiming dla for everyone" or look at it from some angle similar to this.

Am I right in thinking this way, should we leave it and not claim for him, since both of us parents receive dla ourselves.

    if the child has care/mobility needs then yes you should claim dla for the child

    Someone I know both adults receive DLA and also their son does, they also claim carers allowance for him. If you are entitled to it I would claim. The money is to help towards things, but you must do what is right for you and your family.

    It won't make any difference - every person, adult or child, who fits the criteria, is entitled to DLA.

    Carer's Allowance can only be claimed in respect of one person with DLA - so, if you are claiming CA, or the underlying entitlement, for looking after your wife, which you are entitled to do, as she is getting middle rate DLA care, you won't get it again in respect of your child.

    However, if your son is awarded middle or higher rate care, then your wife could apply for CA, in respect of your son, or the underlying entitlement to it.

    (The fact that you are both on DLA does not prevent you claiming CA for another person).

    I know you didn't specifically ask about CA, but claiming this can make a big difference if you claim any M/T benefits, with the 'enhancement premiums'.

  • Hiya,I have two children with very different care/mobility needs..one ASD and one Chronic lung disease/tube fed etc.I faced a bit of criticism when I claimed DLA for both but at the end of the day they look at it on an individual basis and stuff anyone who has a problem with it!
    Hugs to you going through the whole dx process for your child..it's not an easy time xx
