Fake item received

My son purchased a BMW badge which he has received and it's obviously a fake.

The seller has sent message telling him he will refund if my son returns the badge.

Can anyone advise whether it is necessary to return the fake badge or should seller refund the payment and my son destroy the badge.

Thanks for your help.

    Open a snad and let Ebay decide. Or make it easy and just send it back for a refund.

    I think it's Ebay you need to open a dispute in, as then it's up to the seller to prove it's not fake, and I *think* you'll then get a refund and can destroy the item.

    Be careful opening disputes claiming it's fake, as I think a Paypal one will want you to get evidence on headed notepaper that it's fake, which is quite hard to do!

    Thanks very much for advice.

    Will advise son to open dispute in Ebay.

    He could return but will have to send first-class recorded, at his own expense.

    He should have had more sense. A real badge would cost around £50, and this one cost about £5. It's tacky and cheap, obviously fake.

    It's not a fortune that he's wasted but it's the principal!

    There are thousands upon thousands of car badges on ebay, the vast majority of them are fake as under copyright laws the only people who can manufacture them is the copywright holder ie the car maker.
  • When my partner got sent some fake Doc Martens we just sent them back :shrug:
    We reported them as fake to eBay and they did precisly NOTHING.

    If you get fake you need to dispute, not report. That is something else entirely, eBay will fully support a fake dispute and side with the buyer unless the seller proves it is fake.
