Personal Injury Claim following a road traffic accident

I was stationery at a roundabout, when a speeding car hit me from behind, shunting me into a car in front.

The damage to my car was severe, I have a people carrier a VW imprint appeared on my boot, the boot would no longer close and was written off.

I attended A&E with neck, shoulder and back injuries, I was also signed off work for 9 weeks. Still today 3 months later I have shoulder pain and also lower back pain when sitting down.

I so far have had 19 sessions of physio costing me £31 per time.

My car insurance have refereed me to a solicitors to make a claim and today have received an offer of £1700.

I'm not sure if this is good but am concerned if I might have injuries that will last long term.

Can anyone help with some advise on what to do?

  • Hi there
That seems a good amount for a slight wiplash injury, however if you are saying you are and have suffered because of this it is of course not acceptable. You also mentioned time off work, someone will need to pay this bill and if you accept this compensation you may find in theory you could be asked to return and benefit or sick pay that you have had, considering that I would say the offer is nothing like what you need to cover all of this.
Have you had all of your medical exams on behalf of your legal rep?
Most legal reps/ solicitors will want more than this so most will not advise that you accept, what have they said??

I have just been for my medical exam today and I would be happy with this, but I have taken no time away from work and I am just fine now :-)

Whatever you do don't except until you are told to by your lawyer or the legal rep as they usualy have a condition that if you accept outside of them then you will be liable for their costs, thats if you did go conditional fee/ no win no fee?

  • Sorry and one other thing most insurers will offer the physio for free, who is the third party insurer please?
  • Thanks for this, the third party insurer is Tesco, I am with Zenith.

I will speak with the solicitors regarding the physio and also the sick pay.

I have had one independant medical appointment, to be honest this was very brief and 2.5 months after the accident.

    Thanks for your advise.
  • I would tell them what you have told us, unless you already have?
Tesco are usualy ok, but it seems that someone is not doing their job as you will be paying for this support from the independant medical and the solicitor. HTH

if you were on full company pay they have a right to recover, this will be on top of your compensation this also applys to SSP
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
