RBS - massive charges

  • So when it comes to bargaining with RBS to waive charges etc, since April have you made any payments to the account to show good faith that you willing or able to pay back some or all off the money owed. You may be lucky and have some of the charges refunded but you cant expect to get off scott-free.

£400 mobile phone bill hope it was not a drunken night on the 0898 numbers! I think you may have learned your lesson by now but can see the other guys points as you seem to be trying to put most of the blame on RBS. I hope you get sorted but if your spending most of your time arguing with them rather than showing that you are at least trying to pay some of it then they may take pity and try and meet you halfway.

You may get lucky and they may agree to wipe the charges that occurred more recently. But I simply don't agree that the bank did wrong in honouring a payment you effectively issued to your account. It's far too late for that now but the fact it was paid at the time suggests to me that an authorised overdraft would have been granted to you at the time had you asked (ie no £6pd charges).

Now you're at their mercy as to how lenient or otherwise they'll be with you.
  • AFAIK - you can only initiate an indemnity claim if you claim the company were at fault taking the money as it was not in the agreement, didn't the OP say that the bill was run up by his partner, so if the bill was a genuine figure the company were not at fault & no indemnity could be raised - please correct me if I'm wrong

OP - when did you pay the £400 into your RBS account? Have you broken down the charges and interest into what was charged before and then after you paid it ? You could ask RBS to consider refunding the latter (i.e. the interest charge don interest and fees).

To stop it happening again could you ask your mobile phone company to send you an on-line statement a few days before they send the DD to your bank, so that you'll have time to pay money into your account if you need to ? (Actually I get all my bills sent to me like this - mob, bb, landline, gas etc).

banks should not be able to pick and choose whether they decide to bounce DDs or pay them. If I don't have funds in my account, it shouldn't be paid, simples. Inconsistency in the way they treat a lack of funds is the biggest source of my discontent.
You need to understand the nature of your relationship with the bank.

Banks are in business to make money from their customers. They'll do whatever is likely to be most profitable. You've prevented them with just the kind of opportunity they like.

And their main interest now is in piling on the charges to bloat the debt as much as possible before they sell it on.
