Local trader not accepted cancellation of contract
Comments
-
Are the contracts for the kitchen and finance not separate, as more than likely the finance is with a 3rd party?0

That is an awful lot of money.
I would put in writing that the trader has failed to observe your cancellation DEMAND (do not use request) and has failed to recover the deposit to the customer and as a result the matter WILL be filed at the county Court for a judgement within the next 7 days.
That the court papers should arrive within due course.
If they claim the deposit is for materials they have ordered then they must provide those materials to you.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

I mentioned that after a different quote I decided to cancel their contract and attended their showroom providing cancellation form, which was accepted by staff but they say was not retained. i.e. I left with it. I also mentioned I'd attempted to contact company on numerous occasions including email and telephone (leaving voicemail) - to discuss return of deposit due to cancellation.
Does this count as confirmation of cancellation - you've got me thinking!
I'm going to meet them today taking a witness and have read up on O.F.T Guidance for unfair terms and note your points about retaining only provable losses. We'll see how it goes.
thanks for all the help
aslong as you provided a written cancellationthen you should be fine
did you buy the goods in your home or workplace? those regulaitons dont apply if you bought instore.
if you bought instore the contract for goods and contract for credit are seperate -the credit woudl have 14 days cancellation but the services would not.
if you bought at home/work then you would have 7 days in which to cancel the services.0
