    What you don't insist on deposits from seagulls? With my property we get them without even having to ask - problem with coastal property :)

    The tenants would almost certainly have a claim against you for failing to properly secure 2/3rds of the tiles. If one of the tenants develops a falling-tile-phobia and has to spend the rest of his life living in an anderson shelter in Uig then the compensation for loss of a lucrative career in the city could run into millions.
    A kind word lasts a minute, a skelped erse is sair for a day.

    did the tenants inform you at any time? was the damage obvious? you could argue that it is the tenants duty to inform the LL of any problems so that it could be dealt with by a professional (pest control) and that by not doing so it has gone beyond wear and tear?

    I've checked through the lease and it's clear the tenants should have informed us - they must have seen the damage as it's even up the stairs and along a corridor which wouldn't have been covered by furniture.

    Yes, we have receipts for the carpet, which was new just prior to the tenancy starting (£2,500) and, had the tenants told us about the problem, we've been quoted c£100 to have it resolved (which would have been a heck of a lot cheaper than new carpets!).

    I'm going to contact the agent and say we'd like to retain a (large) percentage of the deposit and, if necessary, we'll go to arbitration. I'll keep you posted.

    We've recently moved into an old Church owned property and it's become apparent there are loads of moths on the go here. :( Some of the carpets have these patches, the Factor had no idea what the cause was but thought it might have had something to do with the previous tenant's dog. As a dog owner myself, that didn't seem right to me and now after reading your thread, I'm wondering if this is the same thing you are talking about and the moths are to blame?

    That certainly looks like moth damage based on the carpet that I threw out.

  • Hi aliasojo - yes - that's exactly what moth damage looks like!

    There are a lot of "home" remedies you can get (try Amazon) and they seem to have good reports. After treatment you need to have a good hoover to get up all the eggs, larvae etc, etc apparently - yuk!

    Our agent is now saying he doesn't think we can "pin" it on the tenants - I think they should contribute (our carpets were brand new) - can see arbitration looming!
