failed ppi claim blackhorse

i took out a loan with blackhorse in sep 2004. i recently tried to claim my ppi back but was unsuccessful. blackhorse have advised that the Financial Ombudsman will not deal with this because of the date i took the load i have just over two years to pay on the loan. is this correct what the are telling me?

FOS, not Black Horse, decides whether or not FOS has jurisdiction. They may refuse to investigate but it is not for Black Horse to make the call.0

You could give the FOS a ring to check. There is another option which is to take BH to court-take a look over on the consumer action group they are a very litigous lot over there and can advise on court action if you wanted to go that way.

However there is a much greater risk of losing at court. Whilst BH have an appalling record of losses at FOS, most of the court cases they win.We've spent decades teaching people about their rights, but nothing about their responsibilities.0 -

Well looking over on CAG there seems to be as many wins in court as the FOS, BUT it is a bigger risk.
Basically court action is quicker and can result in higher payouts-but you have to work alot harder and really understand the legal arguements as you have to be prepared to stand up in court to argue it out if they don't settle early. If court finds against you you cannot then go to the FOS.
FOS takes ALOT longer but virtually no risk and they do most of the work and chasing up. Plus if the FOS find against you, you can still then resort to court action.
I was simply pointing out to the OP another option-worth a read over on the CAG to see.
Very few take court ation over here,prefering the FOS, alot do take court action over there. Seems to be just as many wins on both forums so you make your own mind up.
I am just in the initial stages of my claims and haven't decided which way to go yet, but I have used spredsheets over tere to work out what my refunds SHOULD be rather than trusting the banks.
Worth the op checking with the FOS even if BH wan't covered by the FOS at tha time, I believe the insurance policy was with llyodds/bh insurance who were members of the GISC? So the FOS can look at it?
If the FOS won't look at it then court action is better tha nothing.
