Estate agent not passing offer across!

    Faxed offer off including comment that they can have money earlier than I can view it!
    Ready for a ruck...!
    Agent is Halifax and the seller is.... Halifax.


    Errrrm. So I shall just be doing as I am told then.

  • The relevant legislation under which agents are legally obliged to forward all offers without delay, discrimination or qualification is:

    The Estate Agents (Undesirable Practices) (No.2) Order 1991

    The only exception(s) would be where a vendor has provided specific instruction to the agent that (1) they will reject any offer below £x or, as perhaps in this case, (2) where the agent can cite the vendors agreement to their policy that they only pass on offers following viewings. However, the agent would need to show that they have the express agreement of their client or that this is a term of their client's contract.
