Redundancy help needed

I was informed I was to be made redundant last year, they gave me two weeks notice and then I was to leave with redundancy pay.

However, after the two weeks they then asked me to stay for a few weeks more as a favour, I agreed and this has continued till now.

They don't give me any answers when asked how long they want me to stay. I am wanting to leave but I feel I will now loose my redundancy pay as it will be seen as me quitting my job now? Not being made redundant?

Any advice appreciated.

    You really need some clarificaion. (in writing)

    They could argue that your job is not redundant now as you are still doing it, I really think they would have to start the process over again after all this time.

    Do you hve another job to go to, if not surely any job is better than no job at all.

    If they make you redundant these are the rules.

    How long have you worked there, you are entitled to one weeks pay for each full year you have worked there as long as you have worked there for at least 2 years, as well as one weeks notice for each full year you have worked there as long as you are between 22 and 41,
    different rules apply outside these ages.

  • I am not doing the same job anymore, I am sort of just running around doing bits of work that other people in the company want me to do. Before I had a set role of my own work.

    I have worked for them for 4 years, 5 including this year.

    I do not have another job to go to straight away, but I would like to start looking at other options. I'm unsure what to do because I could resign when I find a new job BUT I have been working with this redundancy hanging over me for a year. I really don't know where I stand.

    If I have to leave with no redunadcy money I will, but if I should be getting it I want it as it would help me move on quicker. I have been on hold for a year - not able to remortgage as I had a formal letter or redunancy etc...

    If youre really not happy, hang on to yur job at least you are being paid. Meaning you can at least pay the mortgage.

    Keep looking for a new job and just give your notice in then. I would think your situation now is that your employment is 'normal'
    but like I say, you really need clarification of your situation.Do it in writing to them and expect a reply in writing, you need really to escalate this.

    If they do make you redundant look at my earlier post about the amount of redundancy that you are entitled to.
    Dont let them fob you off with anything less.

    Could you ring ACAS for more advice.

    Dont leave your job for goodness sake though because yu will be sancitoned heavily by the DWP, which pales into insignificance agains 2/4/5 weeks redundancy payment.

  • Thank You, I hadnt heard of ACAS, am looking at their website now.

    I did try to contact my local CAB but there is a long waiting list before they could speak to me.

    I am just hanging on and doing as they ask at work as I need to keep earning the money, but I would like to leave ASAP as it's not the nicest environment to be in, and obviously I am fed up of being messed about regarding my redundancy.

    Just try to be positive, if youre doing this that and the other at least it isnt boring lol.
    Hope you get some useful info from ACAS, youre obviously young, and sometimes employers take advantage of naivety or they are just pure ignorant, which is why there are so many Tribunal these days, while your on the ACAS site just have a look at what youre entitled to if you are made redundant.

    Ive just been made redundant from my job, Ive been there 25 years, am I happy, I'm bloody ecstatic, I was thinking of retiring anyway before winter but now that they have made me redundant, at least I go with a cheque. statutory minimum but nice to have, I will have great pleasure in giving it away to my children as a present, what you never had you never miss lol.'
    I'm away on holiday on Monday for a week but I'll try to catch up with you when I get back. But like I say, stand your ground and dont let them bully you.

    You are obviously not redundant if you are still working. You have de facto accepted suitable alternative employment. You could have objected back then if you had genuine reason not to accept the role, but having done it that option no longer exists.

    Thanks alot for your help. I am going to try get them to put something in writing.

    Ive also been talking to another company today and may be joining them if everything goes well. So hopefully all the issues with my current company can be left behind now.

    It was a bit more complicated than that. It was a favour they asked of me to start with for ttwo weeks extra and now they refuse to answer questions about my employment. Its just been shrugged off, they couldnt/wouldnt tell me when they want me redundant but never took the formal notice back.

    As ive said above I think I will be leaving very shortly for a different job, so hopefully I can leave all this behind me.
  • Good luck with the new opportunity. Sometimes people get hung up on being 'entitled' to redundancy, and hanging on until it transpires, but if you get a new job I would just treat it as a new opportunity regardless of the redundancy situation. That's better than hanging on and getting 5 weeks statutory redundancy and then not finding alternative work for 6 months. (IMHO)
  • Thank You, yeah its what I intend to do. Ide rather just start fresh somewhere else. It has been quite stressful not knowing where I am with this company for a year.
