Sorry, one more wee question. When should the notice in lieu be paid ... she was sacked today - when should she expect to receive it (we will of course be reminding them that it needs to be paid!!!)

Well actually, if they fail to pay the week in lieu (and accrued holiday pay) and she has to take this to a tribunal she could add the failure to provide written particulars to the claim.

The tribunal could (doesn't have to but may well) make an additional award.

You can no longer make this claim on its own.

I know that, but as there's no indication she won't be paid, I didn't bother mentioning it! But yes, you're right. :)

Either on her final day of work, or whenever the next company pay day is due.

Don't forget any untaken accrued holiday.

In round figures this is just over a day for each two weeks worked. It continues to accrue during the notice period.
  • I would give HMRC a call once you have the pay and P45.

Employing kids any sign they may be paying below NMW, could add that

    Thankyou for your reply.

I have tried looknig online for some advice but haven't had much luck really. I was under the impression that surely they have to follow disciplinary procedures first such as verbal and written warnings before dismissal?

No. In the first 12 months of employment no disciplinary procedure needs to be followed. You can be dismissed without reason. The only thing they need to comply with is notice periods.

NMW doesn't apply to under 16s.
  • How unprofessional, my HR would roast me alive.

Do they have an HR dept you can contact?

Legally they are right but morally it stinks.

They can't take their brand protection very seriously.
