JSA Appeal, how long do I wait for a desision

Hi sorry if there is already a thread for this. I've tried to find this info out ont the JS website etc. really struggling to find the answer.

I got made redundant and had to claim JSA tax year 2011/12.
As I live with my partner I was told I could only claim Contribution based JSA.
I was told that I wouldn't receive any money as I had not paid enough NI for tax year 2008/09.
I appealed stating they had used the wrong tax year to calculate.
got a new job but was a fixed term contract after 3 months had to claim JSA again.
I hadn't heard back from the appeal by this point but was aware it had been recived a week after I sent it.
I called up to find out why I hadn't had a response was told a desision hadn't been reached.
I still havent heard back from them, it has been 6 months since the initial appeal and over a month since I called to enquire about it.

Does the appeal automatically fall in my favour if they have not responded after a certain perion of time?

If so, how long do they have to inform me of a desision before it automatically falls in my favour?

    It will never automatically fall in your favour, the decision will stand until it they've lokoed at it.


    You claimed in tax year 11/12, so benefit year Jan 11, so the RITYs would be 09/10 and 08/09? I'm rubbish at working this out, but why do you think they used the wrong year?
  • they use the last 2 full tax years, so that would be 08/09 and 09/10, so if you haven't paid enough in those 2 years you aren't entitled to it.
  • i thought they'd used the wrong tax year because I didn't know it was worked out using 2 tax years and the letter they sent me only said "we have used tax year ending April 2009 to calculate...."

    Pretty much all of the letters I have seen have quoted both tax years on them.
