building society error ..help needed

can anyone help me ...last month my account had £600 deposited into it ..at the time i had only just renewed my tax credit an was told any monies due would be payed directly onto my account within the wk or so ...so when this ammount appeared i assmumed it was from them ...and after checking my statement it just said band credit ..so i thought great it must be from tax credit now i can pay off some bills etc ... but ...today bout 5 wks after the deposit i get a phone message to call the branch of nationwide in newquay ...i do this an im told the money was put into my account in error an they are very sorry but they have taken all my money that was in my account already ..about £300 and i still owe them the other £300...now i have no money to pay my bills and i cant even use my card as it says insufficient funds available ...can they take it back without prior warning? ...after many tears an frustrated calls they are now giving me an overdraft of £600 so that i am able to access my money an i have to pay them back monthly even tho im am struggling as it is to make ends meet ( life is always giving in one hand and taking in the other)...so heres the thing ..where do i stand legally? as altho i can see that technically i do owe the money back and will do my upmost to do so ( even tho i truly wouldn't of kept it, if out of the blue money sprang into my account from nowhere but because the wk before i had finalized my tax credits i thought it was from them?)...am i really liable to pay this back and were they really able to take all my money out of my account without speaking to me first to explain the situation ??? can anyone help with this please ???

  • i admit i must check more carefully what gets deposited into my account ..but please don't call me silly ...I've had a bad enough day as it is :-( ...i am going to pay it back an i am grateful for the help from the b/s..but also a little annoyed as if they hadn't made the mistake in the first place then i wouldn't be in this situation ...honestly if i wasn't expecting a payment i would of been into my branch straight away ..guess i must learn never to presume !!!

  • I give as much as i can ..work hard an do my best ..but it never seems to make a difference to me family ?? I have only just this wk received a final award notice as its been messed around as my son has just started college ...and it stated again any money due will be paid accordingly ...but thats what they said on the phone when i renewed ..hence why when the money went into my account i thought it was from them .....like i say i must learn never to presume an check check check!!! believe me lesson learnt

    Uninformative statements are a pain. If they don't tell you where the money came from, how are you supposed to know if it isn't yours?

  • Thanks for your help ...and comments ...I am now going to be extra careful and even tho its my account and my money going in ( hopefully ) i will be very wary and check just in case by some chance the money in there isn't actually mine!!.... just when you feel your getting somewhere in life something comes along to push you back 5 steps :-( now i know why people shy away from back/building society accounts an stuff there mattresses..... :-/

    You had an overdraft and owed them money........

    i didnt have an overdraft , my account was in credit and has been so i didnt have the need for one ...please read my post properly as if you had you would know this ...i am repaying ...i was wrong to presume the money in my account was mine ...funny i thought thats what bank/ buildings society accounts were for??? ...i just wanted advice if anyone else had had this problem ..not trying to blame anyone but also don't see why im to blame either ...like i said its my account and wouldn't expect any money paid in ..not to be mine???? thanks for your comments
