thanks everyone for your comments - we are still really unsure what to do. We are near to exchange, we want the house and don't want to walk away. We have the added issue that we are very likely to see the vendor after the move has taken place and it could make for a very awkward situation that we would rather avoid.
I'm really cross about it but worried that if we make too much of a fuss, they will call our bluff and take it away - and we really want it! Don't know whether to just leave it as a casual 'we don't wish to pay any more money for it' and hope that they can't be bothered to remove it.....
I LOVE all the suggestions though and have played through saying them all to them in my mind!!:D
so now its a game of who will break first and from the sounds of it (after reading your posts) you will.....
because you really want the house.....all because you want to aviod an awkward situation with someone you will probably only ever meet a handful of times and who you are paying alot of money to.....
It's quite simple.... you say...I want the buildings or we will walk away.....then go looking at other houses.If you find yourself in a fair fight, then you have failed to plan properly

This is farcical! Is someone really willing to lose a house that they love as well as all the non-refundable fees that they have already incurred for the sake of a couple of hundred pounds?
Why not offer to meet the sellers half-way and offer £250 for the summerhouse on the basis that neither party is wholly in the right - there has been a genuine misunderstanding all along.
Yes, I know it feels like giving in, or being held to ransom, but why bring down a bucketful of stress and bad feeling upon yourself for what is, in reality, quite a small amount of money.
If the vendors decide to play silly wotsits, they could perfectly legally remove no end of small items which will cost the buyer a lot more than two or three hundred pounds to replace. Practicality rules, at the end of the day.0 -
You are right 'Paddys Mum' - we won't lose the house over it - I just don't like being taken for a ride because I'm more principled and wouldn't do the same thing to our buyers. Our solicitor is having a friendly chat with theirs about it and what will be will be. I'll get over it soon enough and when we are in the house I'll be pleased whatever the outcome.
I just stew for a few days on these things until they are concluded! Probably not good for the health eh!:)0
