Transferring the tenancy of a council property

The sitution concerns an unmarried couple, who have a very young baby.

One of them lived in a council flat before they had the baby, and the other moved in.

They have now decided to part company.

Am I right in thinking that if the second person is not named on the tenancy agreement, the Council will not transfer the tenancy to their name?

Or does the fact that the transfer will be to a partner with whom the tenant has a child, make a difference?

    I think the answer is 'it depends'. The best thing to do is to phone the Housing Officer and ask them.

    There is a limit to the number of times a tenancy can be passed on, and there may be restrictions on the tenancy in any case, and there is definitely no automatic right to pass it on.

    However, if the parent caring for the child who's hoping to stay in the flat, it's essential that they get onto 'the list' as soon as possible. The council may have a duty to rehouse them if they can't stay where they are.
