The Insolvency Service - Claiming Unpaid Wages

Options
Hi there

I hope somebody may be able to answer this question.

I have recently been made redundant (Friday 2nd) and have been given a form to fill in to claim unpaid wages, notice pay and unpaid holidays.

The form is pretty straight forward but there are two points that i'm not sure about.

1st. My old boss told me I should claim for each of the 5 weeks in August i was unpaid even though I was on a monthly salary.

2nd. My father thinks that as the redundancy started on the 2nd September I should be due the full months pay (Claim August and September).

Can anyone set me straight.

Also my contract was for a 4 week notice period, however I was with the company 6 months and someone said its only 1 week entitlement in this case.

Many thanks

TS

    Hi

as you were only employed for 6 months you won't be entitled to redundancy pay as such... sorry.... but I'm guessing that your employer has gone bankrupt and ccan't afford to pay your wages, which is what you will be claiming from the insolvency service

  • I'm not claiming redundancy only unpaid wages.

Just try to find out whether i should claim

    August
    5 weeks of Salary/52
or August + September as the notice was given in to the 2nd month,
  • you would only have been entitled to one week's notice, that much is right... so therefore if you weren't paid for August (4.5 week month if you would have been paid on last working day?) so you would claim for August plus one week
