Ebay query

Hiya

I've sold 3 items on ebay at £5.45 each plus £1.95 postage.

I've sent item and buyer has confirmed they've arrived ok however he's ordered the wrong item and he wants to swap them for a different item

The other item is £4.75 each plus £1.95, I therefore owe him £2.10 - which is fine I'm willing to do this.

He has said that I'm liable for the return postage plus the postage back to him. I think he's in the wrong as he's admitted he bought the wrong thing but I don't want to say no in case he's right.

I've looked on ebay and there is no mention or return postage and my auction states I'll accept returns if their faulty - surely I'm being fair by agreeing to the swap?

Can anyone help me with this as I don't want him to leave me negative feedback for his mistake.

    Are you a business seller? I'm sure customers have 7 days to decide if they want the item (something about distance selling regulations) and the seller is liable for all postage costs (I might be wrong... I'm sure someone will correct me)

    If you are not a business distance selling regulations don't apply.

    I take it that you're a business in which case you could do with reading up on distance selling, sorry my computer's playing up & won't play nicely today.
    All the rules & regs are written down.
    The rules only apply for BIN not auction sales, I think but I can't get onto it to check.

    If the buyer is at fault or returning the goods for any reason other than faulty/not as described then as far as I know the seller does not have to pay the buyer's return postage. You would have to pay the original postage and in the case of an exchange the postage to send the new item out.

    I tend to sell business to business so may not be too accurate here. You could make a general enquiry to Trading Standards and see what their advice is.

    Hi thanks for all the replies.

    I'm not a business seller - so I don't thing DSR apply to me.

    They were a buy it now, I think I'm right in saying to him I'll exchange them (which I think I'm being fair - he's admitted he's bought the wrong item) but he'll have to pay the postage back to me.

    Thanks again, I thought this was the case but I just thought I'd run it by someone.

    I think we probably assumed that you were a business seller having several items at the same price on BIN.
    As a private seller you don't have to pay the return postage.

    I just assumed the same thing- quantity of similar items on BIN seemed unlikely for a private seller having a clear out.

    I must admit I have never bought 3 identical items for my personal use and then at a later date decided I no longer needed those items.;)
