Hi to everyone,

I'm a new user and not sure if I have come to the right place!

Can anybody help me as I'm no legal expert!

My mother died in December 2010, leaving me (her last living child), and 12 grandchildren as beneficiaries to quite a small Estate of around £47000. The Executors of the will have received probate (in early June) and a lengthy DWP investigation has just been concluded. My mother was a very honest lady and there were no issues there.

We all just want closure now. I miss her more and more every day - she was my whole world. She lost all her other children, 2 to cancer, and together, we buried them and tended their graves. I am disabled myself and she would always scold me for trying to do too much! I have nobody left to turn to for advice - she was always there for me!

It's almost like every circling vulture wants a piece of the modest Estate. A lot of it will be held in trust for the grandchildren until they reach 21 - my own children included.

The executors are now claiming it is their legal obligation to pursue an investigation that a buy to let re-mortgage my mother had finalised in 2009 was mis-sold to her and they are seeking to claim a small compensation of around £2000 to the Estate, which, in my opinion, is not in the best interests of the Estate as it will barely cover the costs to the solicitors! I have asked them not to and they are saying it is their legal obligation, we have no rights, the money isn't even ours yet (!) and we have to stop calling them! I was in tears today - it has NEVER been about the money at our familys end! How can they cheapen my grief like this? We want a little respect and dignity for my mother's memory. I had to personally oversee a very painful tribunal investigating her cause of death. (She died because of a bumbled routine angiogram.)

Sorry, my question is, are the executors allowed to treat my family this way? Can I really not do anything to stop further anguish to the few my mother left behind? (My eldest nephew has himself just undergone open heart aortic root surgery!)


Sorry for the lengthy post, but it feels like I have finally just let out 10 months of anxiety. I have no clue about all this stuff - even the funeral was mystifying as my mam always sorted everything out.

    Who are the executors? a law firm or just people?

    Could you google the name and find out?

    Sadly this may be more about them being able to increase their fees than any gain for the estate.

    Are they going to be adminstering the trusts set up for the younger children?

    There are some solicitors who frequent the site who may be able to help. I am not sure that they visit this particular forum though!

    May I suggest you repost (copy and paste as a new thread) your question on the House Selling and Renting forum? I think you may get some more responses there. I know it isn't exactly appropriate but it does concern a buy to let mortgage! Fingers crossed!

    Most probate and wills stuff is either here or on the over 50 forum, unless it includes houses as part of the estate.

    Contact the solicitor ombudsman for advice.
