Property not registered in our name - selling on?

    solicitors only use the land registry for registered properties, so it looks like you have got away with it.

    Deeds are for historical interest only once the property has been registered.

  • We've had a few problems with credit being declined over the past few years so I wonder if he just bit the bullet and put it through and reported a non payment?

    Your solicitor will have had a duty to your mortgagee to register the property in your name and protect the mortgage so I would surmise that is why it was done.

    I don't know why you weren't chased for payment and if you have had difficulties getting credit then it might be as well to check your credit record and see what is going on.

    Since the coming into force of the Law of property act 1925, made registration compulsory on any "sale" of land. So your post is must odd.

    deary65 - just not true. i think it was as recent as the 1970's that compulsory registration came in.

    A little history:

    The 1925 L.P.A was an assimilation of all the land laws of England & wales.The reason, on a conveyance of land, a lawyer could have as many 100 documents to have signed and an equal number of different people to sign them.Such persons could be anywhere in the empire making a conveyance of land almost impossible. The act made it compulsory on a sale to register the land simplifying the procedure in the interests of commerce.

  • After speaking to an estate agent today he said the sale didn't seem to be registered at the land registry.

    But the title deads from thelandregister.gov.uk have us listed as the owners. Does that mean everything is covered?

    Ask the estate agent where he got his information from. If you are registered as owners on the land registry documents then I don't know what the estate agent is talking about (and neither does he by the sounds of it).
