    Totally agree - Hertz were quite simply never 'required to pay' for a breach of contract allegation against the driver.

    The Edge, please use the same approach as the pepipoo poster I linked, to force your money back.

    So Hertz would pay any council parking tickets automatically even if the parking attendant was an idiot and raised a ticket for no reason?

    PPc have list of registrations of hire cars, I know this first hand, if they see it been driven they just write a fake ticket, they know it is money in the bag.

    Which Car-hire company has the little stickers on the back to identify it as a Hire car?

    I bet the PPC monkey loves it when he sees one of those in his car-park, writing out a ticket just for the hell of it.
  • The wording in the Rental Agreement is as follows:

    You are responsible for payments of all fines, road tolls, congestion charges and other similar charges incurred in relation to the vehicle during your rental.

    Some of these charges and fines will be sent to us for payment, which we will pay and recover from you. Alternatively, we may be required to provide your details to the relevant authority, who will contact you directly. Either way, we will recover the costs we incur through a reasonable administration charge.

    Those are statutory charges .

    So that means other statutory charges.

    Yes but a Private Parking Company is not an "authority"

    They have no right to pay a speculative invoice and they certainly should not be charging you for their error.
    By paying they have effectively removed your right to dispute the charge.
    (That would apply to them paying a real FPN or PCN too...who exactly do they think they are !!!)
    A PPC is not an Authority and they have no obligation to disclose information to them,as such any disclosure is a breach of the Data Protection Act for which they owe you some compensation.

    Agree with Sirdan, plus this is not a charge in relation to the vehicle, it's an alleged breach of contract against the driver only (you). So none of their business even though the PPC wrote to them, it doesn't change the facts and doesn't suddenly make the PPC an authority.

    Otherwise the car hire firm would be saying they would pay any old claim that mentions one of their cars, from any private company (no doubt they would).

    Well it is not on so do as advised before, copy the pepipoo thread advice I linked before as their wording was brilliant IMHO.

    Took some time but this is their response. Totally ridiculous of course, and the person that has responded doesn't seem to get it at all:

    Thank you for contacting us.
    Normally after traffic violation local authority contacts Hertz in relation
    to the offence asking for the details of the driver. By law we are required
    to pass your details to them. By doing so we are charging you the
    administration fee of 42.00 EUR for the offence they claim you have
    committed.
    We have the authority to waive our administration charges however we can
    not affect the fine itself. As mentioned in previous correspondence you
    must contact the local authority directly if you wish to dispute the fine
    since we have paid it on your behalf to stop it from increasing. This email
    entitles you to dispute the fine.
    If the local authority admits in writing that they have made a mistake and
    you forward their letter to us we will gladly issue a refund of 50.00 GBP
    to the cradit card charged.
    I would like to take this opportunity to thank you again for contacting us
    and we look forward to
    serving you in the future.

    You should tell them to read your mail again, and then respond the actual points made. Point out to them that this is not in any way a traffic violation, nothing to do with local authorities, and that there is no legal obligation in this case to pass on your details, thus making their entire response utterly irrelevant. Politely, of course.
