Carquake Deposit Refund?

Last week i agreed to purchase a car from Carquake, its a superb deal but i needed it ASAP, i informed the Carquake salesperson who assured me it would be available within 4-6 weeks.
However after agreeing the deal, i gave £500 deposit and they then sent through the purchase order for me too sign, however when i got the forms i noticed delivery date for Jan 2012?
Spoke to Carquake and they reckon it'll be there within the initial time-scale and said they just put Jan 2012 as worst case scenario.
I am now a bit worriered about placing the order now as i cannot wait any longer than the 6 weeks max, Carquake say it will be fine but no guarantee, i have been bitten like this last year where i had to fork out another £1000 to extend my lease deal due to car been delayed.
Will i be able to reclaim my deposit if i do not agree to this i have signed nothing yet?

    The most the seller is allowed to retain is any provable losses. However, seeing as they have varied the terms of the contract, they should refund the whole amount.

  • Spoke to someone at Carquake last week, told them i am not happy and she said they will look into it and would refund me if that was the case, i have returned the forms unsigned and asked for my deposit back.
    Still waiting to hear back from someone.

    I wouldn't let them be the ones who sit there doing nothing. You are going to have to badger them.

    Sorry Theguru, but do you mean you have received your refund, or the bank has returned the refund to Carquake?
