Hello, I have just read the very good thread on faulty goods, so will have a look at both websites, however, can anybody help me here, we bought over the internet a garden trolley so we could put our red and blue boxes in it and take it to the gate (we are not youngsters!) and they get heavy.

The trolley was advertised as heavy gauge steel construction, heavy duty outdoor coating, so we thought it would be perfect. We stood it on our path at the back door, put the recycling bins in it, and away we go!!

One week after purchasing, we pulled the trolley down our path which is on a slight incline, and rust poured out of the trolley on both sides staining the block path, it also stained the path where it was stood at our back door.

We e mailed the company to tell them, and they telephoned us and told us buy some Hammerite or similar and spray the trolley where it was going rusty.( We only bought it in November!! ) We bought the Hammerite but have not used it yet, it cost £ £7.19 with Focus 10% off,, we were not happy about this and e mailed them again and asked them for the £7.19!!!!!

Today they phoned us again and said they had asked their suppliers and no the trolleys could not be completely sprayed with green in every place and where water collects in certain places it would go rusty, however, the trolley was fit for purpose,it was a garden trolley, had been used and they refused to take it back or pay for the Hammerite.

Actually sending it back would be a major operation as it is large and very heavy but we would have packed it up and sent it at their expense which of course they will not accept.
According to them it is a garden trolley, is expected to be used in the garden, and if we want to keep it, put it on something that it won't stain.

At present its in the shed which was a major operation getting in there, we cannot keep it there, well cover it up then was the answer.

Any thoughts on this from anyone would be helpful. We have a friend we can give it to, but it cost £64.99 and seems a waste of money as we cannot use it for what it was bought for.

    Sorry to hear that you are not happy with this trolley. I'm afraid to make it worse I have to say that we bought one of these in our local garden supplies superstores for less £39.99 (I have seen it advertised mail order for £64.99) We keep ours in the stable and use it to cart garden tools and sacks of mowings to the kerb for collection as they are so heavy. You need to decide if its usefulness outweighs the disadvantage of the rust. If you decide to reject it and bought it using a credit card you may be able to get the credit card company involved in obtaining a refund. I dont think these trolleys are designed to be kept outside all the time but they are heavy duty and would still probably last a long time even if kept outside. I suspect only a 100% plastic type would not rust.

    Fit for purpose is very much a matter of opinion. It seems to function as it should and simply because there is some rust somewhere on it doesnt mean that it will not forfil its purpose. My father had one that must have been 40 years or more old and it was used daily to move industrial filters and valves (dont ask why he stored them at home) and whilst it looked to be made 100% of rust it never failed/ worked perfectly.

    I think there would also be an argument that an item intended for garden work is intended to get dirty etc and so an argument based on the aesthetics of rust is unlikely to succeed.

    I think a court would infer the description of the item as meaning rust should not develop within a week. i would not expect that of an ordinary trolley. there certainly seems to be a case of misdescription, but that is for the court to decide. I cannot see how otherwise. But then, I am not making the decision.
    Don't bother trying to sue me - I've got no money!

    Thank you for your replies which are much appreciated, yes we think you are probably right, like the company said its fit for purpose, and if we kept it off the path which is not possible nobody would notice, apparently the water collects in the folds of the metal where it has not been treated, but the rust came on so quickly, and of course as we have to drag it up and down the new block path every week, if its been raining, then it trails rust on the path and it will not come off.
    We took it that if it said heavy duty outdoor coating, then it was safe to leave it outdoors, so will give it to a friend who can make use of it.
    Yes you are correct about the price, saw one today on a mail order catalogue that came with the paper and it was £50 so heaven knows what they are coming into the country at, very little we presume. Made in China.
