Child Tax Credits Backdating help!! PLEASE!

    You shouldn't have to wait for the tax credit notice, as you should be able to just add your new partner to your HB claim and have the claim paid based on your actual income at the time. The HB office don't need the tax credit notice either - they can obtain your tax credit payments directly via the DWP in seconds. So in practice, you would tell the LA that your partner has moved i, provide proof of your joint income and capital and let them know that a joint claim for tax credits had been made. The assessor would then amend your claim and pay it based on what you were receiving at that time, and keep checking for a decisiion on your tax credits award, and add the tax credits to the claim once they started. The arrears payments of tax credits are disregarded for HB/CTB purposes in any case.

    If you don't currently have an active claim for HB/CTB I would make one as soon as you can!

    When my husband moved back in with me, which was a fair while ago now. I told the Housing benefit people straight away and the HMRC too. the housing benefit people changed my single claim to a joint claim and as far as i was aware, so did the HMRC.... i only found out when renewing my claim this year that the HMRC still had me down as single.

    so the housing benefits people were aware of my joint claim.

    My husband is on Income based JSA and i am a named claimat on his claim- i dont have to physically 'sign on' as we have a young child (18 months) but my husband does. the only income we have is the joint JSA. As far as i am aware, the tax credits amount would not be any different, Money wise, weather it was a single claim or a joint claim, so there should be no money overpaid on their behalf.

    Thanks for your advice.. im sorry if i sound stupid, but im not quite sure what you mean... im not very good with benefits.. :(

    as the claim for HB and CTB automatically stopped, would i need to put in a totally new claim for this or just get it re-instated?

    It depends on whether your claim has ended or not? You have said that it stopped, but is it suspended or has it actually ended? Your tax credit claim shouldn't be an issue if you are in receipt of JSAIB, and if JSAIB was in payment a claim certainly shouldn't be ended or suspended because you are waiting for a tax credits award.

    It sounds like you need to visit the LA if possible to find out what has happened to your claim.
