So it is OK for them to keep accepting orders AND payments in the full knowledge that they cannot fulfill and that refunds will need to be issued?
I was assured that their system cannot hold items on order until stock becomes available.

Yes, if they know they have stock coming in within a few days or so whats the problem?

It's not they can't fulfil the order, just means it won't be dispatched as quickly
