Faulty ring purchase in Barbados

My mum purchased a ring while on holiday in Barbados, she paid extra to get it resized. When showing me the ring on her return to the UK I noticed cracks in the band, now after only 80 days one of the diamonds has fallen out. We have contacted the company directly and they are saying the ring comes with 14 days of warranty. They have given us 2 options 1) Get an estimate from a local jeweller and they will pay part of the cost 2) Send the item to their New York office to be repaired with a charge (we are also responsible for all shipping charges).

After showing this to 4 of our local jewellers they have all insisted the ring be sent back as the faults have been caused by the resizing and also noticed that none of the other diamonds were set correctly. They are saying as this is faulty the 14 days warranty shouldn't come into it and they need to take responsibility for selling this product on by fully replacing it.

I'm struggling to get any advice on consumer rights abroad, also I'm unsure if these rights will be different in Barbados and New York. If so which would be applicable, place of purchase or their head office? I just can't fight this without having my facts right in the first place!

    You can't fight this in the UK, any action you take would need to be in Barbados or New York. It's all very well the four jewellers saying it should be sent back but not much good if the store in Barbados are not going to repair it. I would get a price for repair from one of the jewellers and find out what goodwill they are offering.

    If you hadn't mentioned the two options offered I would have said you were stuffed.

    The company have given you two options, if I were you I would pick one. Probably the first, if you mess around here I suspect they will withdraw the offers.

    Did you pay the required duties when you brought it back in to the UK?

    Just a thought, if your mum paid by credit card you could maybe get them involved (I assume a diamond ring is over £100). They may get involved if they agree that the solutions you have been offered are unfair.
