First Direct ppi not paying past 2005

I have a ppi mis selling claim, First direct have agreed i was mis sold and have now sent me a settlement letter.
They will only pay from feb 2005 to present and as i have seen on this site if you are firm and stick to your guns they can agree to take the average payment over a year say 2005 to 2006 and take that as a basis to pay from pre 2005.
Sadly they will not agree with this for me, they said they used to do this but wont now and if anyone now gets awarded for pre 2005 then its a special case.
Wondering what to do next, have spoken to FOS who said if i like i can make a complaint but from what i see this could take a very long time.
Should i just take the payment for 2005 to present, i have been paying ppi since year 2000 so im really only getting half the amount.

Sounds a bit fishy. How can they admit fault but only reimburse in part?
However if you take the complaint further with the FOS, you'll likely be waiting another 2 or more years for it to be resolved, so it all comes down to if you're willing to wait a long time or not.:www: Progress Report :www:

Have you any ststements previous to 2005 that show you paid ppi?,they will have to look at this again if you have.0

Sadly i cant find them, this is what first direct are asking for.
Dont want to wait 2 years even though i have letters from first direct saying that i am entitled, dont know if that will speed things up, its probably a case of so many people claiming the backlog is huge.
Looks like i will have to just take what first direct have offered

Did you send them an SAR at the beginning of your complaint? Might be worth doing now just to force them to dig up any older information they have. I've had no problem getting information going back to 2004 from them and they've even managed to produce some stuff as far back as 1996 (having originally said they didn't have any). You could also state in your SAR request that you are currently seeking legal advice and advice from the FOS about their failure to refund all mis-sold premiums. Neither the courts or the FOS would necessarily go along with what First Direct have said and First Direct will automatically get charged if you took the case to the FOS so it's in their interest to stop you from doing so by making more of an effort with your settlement. Also ask them what their definition of a special case is!0
