counter notice worries

hi , i was made redundant a month ago and have been put on three months garden leave.
i have just received my severance payment and my payments in lieu (3 months salary) in advance of working my full garden leave.
i also have the opportunity of a new job starting in 2 weeks so all is fine at the moment
my concerns however are :
1) do i need to inform my company about leaving early with a counter notice ? (as i have received all my benefits am i essentially a free agent now ?)
2) the new job will bring me directly into competition with my previous company - i had no competition restriction clauses on my contract of employment , but if my previous company are not happy with this could they try and claim back my severance payment or even take legal action ?

    I am confused - gardening leave or pay in lieu of notice? The two are different and the advice on the first question depends on the difference!

    If there is no restrictive covenant the the former employer cannot do anything.
